LAW 7301 - Civil Litigation: The Decline and Demise of Jury Trials in Civil Cases

Examines the background and the recent history of jury trial practice in state and federal courts in the United States. Topics include the Constitutional right to jury trial in civil cases in federal court cases in the United States; a comparative analysis of the rights to jury trials in selected American states including Texas; the influence and impact of the adoption and amendment of the federal Rules of Civil Procedure on jury trial rights and practices in federal courts in the United States; the impact of the adoption and amendment of the Texas Rules of Civil Procedure on jury trial rights and practices; the impact of arbitration rights and practices on civil jury practice; and the impact of alternative dispute resolution standards and practices on civil practice in Texas courts. Prerequisites: LAW 7385 Texas Pretrial Procedure , LAW 7386 Texas Trial and Appellate Procedure , or permission of the professor.
