BL 6224 - Legal Management of Human Resources

Hones students’ ability to recognize, critically assess, and manage many of the significant and recurring legal issues that arise in the employment context. Takes a practical approach in equipping managers to effectively handle workplace issues and mitigate the risk of litigation while simultaneously protecting the business’ legal position in the event litigation does ensue. Includes topics such as protecting intellectual property in a competitive environment; strategic principles for designing, drafting, negotiating and administering employment contracts, including noncompete and confidentiality agreements; recent developments in discrimination and sexual harassment law; and the competing interests of the employee’s right to privacy and the employer’s right to know, such as the content of employees’ email messages or what Internet sites they visit. Also discusses the inherent risks in terminating an employee and the use of a release of liability as a risk mitigation device. The format of the class is a combination of lecture, informal class discussion, and case studies. (*updated* 12/1/2021; effective spring 2022)
